Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Mack Made Wood & Steel Creations (“Mack Made,” “we,” “us,” or “our”). By accessing our website, placing an order, or otherwise using our services, you agree to these Terms.

1) Eligibility & Account

You must be at least 18 to purchase. If you create an account or submit information, you’re responsible for accuracy and for any activity under your account.

2) Products, Custom Work & Approvals

1. Made-to-Order. Many products are fabricated per order. Photos are illustrative; finishes can vary due to powder coat batches, raw steel characteristics, and screen/lighting differences.
2. Customizations. For custom or semi-custom pieces, we may provide a proof. Your written approval starts production. After approval, changes/cancellations may not be possible or may require additional fees.
3. User-supplied artwork. You represent you own or have permission to use any designs you provide and you grant us a license to fabricate from them. You agree to indemnify us against claims arising from your provided content.

3) Pricing, Taxes & Payment

1. Prices. Prices are in USD and may change without notice until you check out.
2. Payment. We process payments through third-party processors (e.g., Square). By paying, you agree to their terms and authorize charges for your order, taxes, and shipping.
3. Taxes. Sales tax is collected where required by law.

4) Lead Times, Shipping & Risk of Loss

1. Lead time. Typical fabrication time is posted on product pages but may vary with workload or material availability.
2. Shipping. We ship to addresses you provide. Larger items may require freight delivery or local pickup. We’re not responsible for delays once carriers have the package.
3. Damage in transit. Inspect on arrival. Report carrier damage within 7 days with photos; keep all packaging. We’ll repair or replace at our discretion after verification.
4. Risk of loss. Passes to you upon delivery by the carrier to your address.

5) Returns, Exchanges & Cancellations

1. Final sale. Because items are made-to-order, all sales are final except for verified defects or shipping damage reported within the stated window.
2. Defects. If you believe your item has a manufacturing defect, contact us within 14 days of delivery with photos. If confirmed, we’ll repair or replace. Normal wear, misuse, and environmental exposure are not defects.
3. Cancellations. Standard items may be cancelable within 24 hours if production hasn’t started. Custom items are non-cancelable after proof approval.

6) Limited Warranty & Safety

1. Workmanship. We warrant that fabricated items will be free from manufacturing defects at delivery.
2. Finish. Powder coat is durable but not indestructible. Outdoor exposure, salt, chemicals, impacts, and abrasion can degrade finishes and are not covered.
3. Safety & installation. Metal art can be heavy and can have sharp edges or points. Mount securely into appropriate studs/anchors per weight and environment, keep out of children’s reach, and use protective gear when handling. You are responsible for proper installation and safe use.

7) Intellectual Property

All site content, product photos, designs, and marks are owned by Mack Made or our licensors and may not be copied or used without permission.

8) Acceptable Use

You agree not to misuse the site (e.g., scraping, introducing malware, attempting unauthorized access, or violating laws). We may suspend or terminate access for violations.

9) Third-Party Services

We use third parties (e.g., payment processors, shipping carriers). Their services are governed by their own terms and policies.

10) Disclaimer; Limitation of Liability

Except as expressly stated, the site and products are provided “as is.” To the fullest extent allowed by law, we disclaim implied warranties and will not be liable for indirect, incidental, special, or consequential damages. Our total liability related to an order will not exceed the amount you paid for that order.

11) Indemnification

You agree to defend and hold us harmless from claims arising from your misuse of the site or products, or from content/artwork you supply.

12) Governing Law & Disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflicts of laws. The exclusive venue for disputes is the state or federal courts located in Idaho, unless small-claims rules apply. You and Mack Made waive jury trial rights to the extent permitted by law.

13) Changes to the Terms

We may update these Terms at any time by posting a new “Effective date.” Continued use after changes means you accept the revised Terms.
